The U.S. Court of Appeals for the District of Columbia has ruled in favor of the cigar industry in the case Cigar Association of America et al. v. FDA. The court affirmed that the FDA's regulation of premium cigars was arbitrary, as evidence on the risk profile of premium cigars was ignored. As a result, the FDA’s rule on premium cigars has been vacated. The decision sends the case back to the district court to further define what constitutes a "premium cigar." "This is a great victory for the cigar industry," said CAA Chairman Javier Estades. "CAA is proud to have led this effort alongside our partners to secure this outcome."
